According to a press release from eBay, the JK Rowling injunction was against eBay sellers and not eBay itself. The case started in 2004 against a specific seller named Baazee.com. The injunction required those specific sellers to stop listing the illegal items. It was not an injunction requiring eBay to proactively seek out and remove illegal listings.
According to a press release issued by eBay India yesterday, “the Delhi High Court affirmed the 2004 injunction against the 4 offending sellers who had been selling ebooks” in January.
