The Google Case Grinds On – The Authors Guild suffers yet another blow in this 8 year court battle. This week the Second Circuit has overturned the district court’s decision to certify the disparate authors as a class so that the question about Google’s scanning and indexing of books would be judged on the fair use defense. Instead the Second Circuit has said that the lower court must decide first whether Google will prevail on the fair use defense.
Prof. Grimmelman believes that this signals the likelihood that the Second Circuit believes Google will win the fair use defense. Indeed, the court wrote that the fair use question could “perhaps moot our analysis of many class certification issues.”Publishers Weekly

DirecTV has the edge right now among bids to buy Hulu – I’m so ready to pull the plug on satellite and cable services so it distresses me to see that DirecTV, a company I can’t stand, is positioned to make the best bid for HULU, a network sponsored ala carte video subscription service. For those unfamiliar, for a monthly fee you can have access to individual episodes of television and movies thus avoiding the need for a cable subscription if all your needs could be met through that service (or a combo of services like Amazon Prime and/or Netflix). I’m not sure what DirecTV’s ownership of HULU would do to the service, but I suspect nothing good.

Taste Receptors In Testes And Fertility – Surely this will be the basis for some futuristic science fiction novel. The body has dozens of locations were taste receptors exist but one particular area is the testes and researchers have tied taste receptors to fertility. Blocking the taste receptors in mice, for example, render them infertile. Business Insider
